STOCKYARD Ltd TERMS AND CONDITIONS OF HIRE (See below for specific Sanctuary Backcloth terms and conditions of hire) Parties (a) The hirer is Stockyard Limited, Unit A Genesis, Rainsford Road, Park Royal London NW10 7RS (b) The Customer is the person named overleaf. If the business address for communication and service of the Customer is not in the United Kingdom, then the agent named overleaf shall be jointly and severally liable with the customer to Stockyard and the address for communication and service for the Customer shall be that of the agent. Law All parties agree English law applies and submit to the jurisdiction of the English Courts. Official Order All transactions with Stockyard are to be on order forms quoting items and hire charge as agreed for a period on a weekly basis. All items are to be covered by customer's official order. Hire Charges 1st week - 10% of quoted risk value 2nd week -17.5% of quoted risk value 3rd week - 22.5% of quoted risk value 4th week - 27.5% of quoted risk value Subsequent weeks - 2.5% of quoted value Special hire charges for long periods will be pre-arranged as stated on the order form. Items reserved and subsequently cancelled may be subject to a cancellation charge at Stockyard discretion. Extended Hire Prior notice in writing shall be given to Stockyard by the Customer to extend hire period. Payment Due for all services at the time of hire (in case of extension at the time of notice), except for account customers, when payment is due on first 2 hires upfront and then by 14 days of dated invoice (unless agreed otherwise by Stockyard) Loss/Damage and Insurance Items should be kept in good repair and condition. Items damaged or altered will be restored by Stockyard who will charge on the basis of cost of restoration .Items not returned or which cannot be restored will be charged at insurance risk value as detailed on hire. It is the responsibility of the customer to insure with reputable London insurers at the insurance risk against loss or damage howsoever caused from time of collection until and return and to produce a certificate of insurance on demand. Collection and Delivery Collection and return of goods is by Customer, unless pre-arranged to the contrary when this service will be charged as an extra. No alterations shall be made without prior written consent of Stockyard and shall be subject to the conditions of such consent. Labels identifying items as the property of Stockyard shall not be removed. The location of all items at all times shall be confirmed to Stockyard on demand .No items hired shall be used for any other purpose other than that for which such items are hired and shall not be lent or sub-hired to any third party. A penalty charge of £30.00 for props returned without our paperwork. Fitness The customer shall indemnify Stockyard against all claims and expenses in respect of damage injury or loss arising directly or indirectly out of the use or condition of the items and shall be responsible for selection. No warranty of fitness is given by Stockyard. Customers are respectfully reminded of copyright legislation and Stockyard shall not be liable for any possible copyright infringement. Surety Stockyard may request a surety and if this is agreed, the guarantee of the surety to Stockyard shall be for the due performance by the customer of all the hire terms and conditions and any time allowed or forbearance shown to the customer shall not relieve the surety from liability upon such guarantee. Packing Cases Packing cases which are supplied free of charge for the hire period shall be charged to the hirer if not returned or replaced Cancellations of Order A booking fee or 10% of hire will be made for orders cancelled within 24 hours before collection BACKCLOTHS GENERAL TERMS AND CONDITIONS OF HIRE A Charge will be made for: 1) Cleaning and removal of dirt, debris, stains and marks. Damage will be assessed and appropriate charge will apply. 2) Damage caused by folding or creasing. Charge for stretch and spray £75. 3) Damage, especially that caused by staples. We would prefer staples not to be used, but if they are they must be removed carefully with a staple remover. Do not pull the cloth as it will tear. Any rips will be charged at a minimum £50 each. 4) Non-return of roller = loss charge of £50. 5) Irreparable damage or loss will be charge at stated risk value above. 6) Cloths must be rolled on tumblers with picture on inside. SANCTUARY BACKCLOTHS SPECIFIC TERMS AND CONDITIONS Notice To Clients All backcloths are cleaned and stretched when returned to us to ensure that they leave the studio in the best possible conditions. However, creasing does sometimes occur in transportation, hanging etc. If this happens the customer should contact us immediately and we will advise on how to rectify the problem. Backcloths are rolled on a pole for their protection during transit. Clients arranging their own transport must ensure a suitable vehicle is provided. Terms Of Hire The hirer is responsible for the insurance of the full value of the backcloth and the total hire fees from the date of collection until the date of return. We recommend that the backcloth is viewed by the client, especially Textures, as no refund can be given once the backcloth has been collected. A 10% cancellation charge is made once a backcloth has been ordered. Extended Hire Extended hire is charged by the week at a rate of 7.5%. If a cloth is returned part of a week late, the whole will be charged for. Reproduction Rights The hirer is limited to one assignment per hire. Damage to the Backcloth and Roller The customer is asked not to crease, staple, fold, clamp, wet or apply camera tape to the cloth as this may cause damage. If staples are used, they must be carefully removed. Pulling the cloth may result in tearing. Any rips will be charged at a minimum of £50.00 each. The roller is specifically for transport purposes. It may not be long enough or strong enough to suspend the cloth. Repairs to the Backcloth Having been informed of any serious damage, the hirer will be given 7 days to view the cloth at Sanctuary Backcloths' studio. Repairs may only be carried out by us and should not be attempted by the customer. Fireproofing The backcloths are not fireproofed. However, the cloths can be sprayed with Flamebar FP6 on request. This is the British Standard requirement for cloths used in a public place. The client should give Sanctuary Backcloths at least 48hrs notice before the required collection time. Non-account Customers Credit card details are required as a deposit. If additional costs are incurred, a revised invoice will be sent followed by a statement. If no payment is made and no objections raised, we reserve the right to claim the amount from the credit card. ARTIST BACK CLOTHS SPECIFIC TERMS AND CONDITIONS All backcloths are to be collected from and returned, to the above address in the condition they were collected in, i.e. in transit tubes or rolled. Insurance must be taken out by the production company to cover the cost of backcloths lost, damaged while on hire, whether in store/use or in transit. Clients hire backcloths at their own risk assessment in safety requirements. (All cloths when new were made using flame retardant canvas/linen and painted using flame retardant emulsion.) No guarantee can be issued due to cloth age and varying fire standards. Cloths may be sprayed using Flame Retardant P.E.6 in the studio if required with prior consent.
